Q: I had a question about the use of overtime for time off. I have read the policy, but want your interpretation on it. Here’s the scenario: I had 5 hours overtime on Sunday and want to use 2 hours on Friday for time off. Should I get time and a half off for that time? My boss said no, I only get straight time when using overtime for time off. I will have 40 hours worked, by 10 am Friday (we start at 7am). Shouldn't I be able to use 2 hrs of overtime as time off and leave at 12:30 p.m. on Friday? Assuming I get time-and-a-half for overtime used.
A: Overtime is defined as hours worked in excess of 40 in a week. Our work week is defined as Sunday midnight through Saturday midnight. Therefore it is impossible to work overtime on a Sunday. For compensation purposes, overtime is not defined as more than 8 in a day, but more than 40 in a week. It is not uncommon for employees to flex out time in a week such as you describe, where you leave early on one or two days to off set the additional time worked earlier in the week. This allows the employee the time off while preserving their leave bank and still maintaining 40 hours of pay. But the time and a half eligibility does not apply until the end of the week is complete and 40 hours have been exceeded.

If you leave early and the net hours for the week is 40, then there is no overtime. If this does not answer your question, let me know.

Comp Time
Q: How do I know if I am eligible for comp time?
A: Speak to your department personnel records keeper, your manager or call the Human Resources Department at 464-5410. The designation for your position can also be found in the Classified pay plan listings on our website or the same listings in your office.

Q: How do I figure how many hours of comp time I’ve earned?
A: Comp time is calculated the same as overtime pay. It is one and one-half times the number of hours actually worked beyond your regular work week. If your normal work week is 40 hours and you actually work 44 hours, your earned comp time is 4 hrs x 1.5 or 6 hours.

Q: When can I actually use the comp time I accumulate?
A: You may request and be granted comp time off under the same conditions as you would any other leave request except that it may not be used in the same week it is earned.

Q: What is compensatory time?
A: Hours earned by County classified employees for hours worked in excess of:
  • 40 hours in one work week (Classified Category "A")
  • 80 hours in one pay period (Classified Category "B")
